Lingmah — Terms of Service

This document is provided for transparency and App Store submission and is not legal advice. Have it reviewed by a qualified lawyer before public release. Governing law is intended to be Kazakhstan.

1. Acceptance

By downloading or using Lingmah you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

Lingmah is an educational app for language learners. If you are a minor under the age of consent in your country, you may use Lingmah only with the consent and supervision of a parent, guardian, or school.

3. Your account

You can use Lingmah as a guest or sign in with your phone number via a one-time SMS code. You are responsible for activity under your account and for keeping access to your phone number. You may delete your account at any time from Profile → Settings → Delete account.

4. Subscriptions, trials & payments

• Lingmah offers auto-renewing subscriptions (for example, Lingmah Pro, Battle, and 4 Skills) and some one-time purchases. Titles, durations, and prices are shown in the app at the point of purchase and are billed in your local currency.
• Auto-renewal: a subscription automatically renews for the same period unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.
• Free trials: where offered, any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing & cancelling: purchases are processed by Apple (App Store) or Google (Play). Manage or cancel your subscription in your App Store / Google Play account settings — deleting the app does not cancel a subscription. You can restore prior purchases from any paywall via Restore Purchases.
• Refunds: all payments are processed by Apple (App Store) or Google (Play), and refund requests are handled by them under their own policies. We do not process card payments and cannot grant or deny store refunds directly.
• Consumed content & no pro-rata: a subscription unlocks a service you use over time. Except where the law requires otherwise, we are not obliged to provide partial or pro-rata refunds for a billing period already begun, for time already elapsed, or for lessons, exercises, AI generations, tokens, or features you have already used.
• Access ends on refund: if a refund is granted for a purchase, the paid access it provided ends, and related benefits (such as Pro features or competition entry) may be removed from the account.
• Fair use & abuse: to keep the service sustainable, we keep records of account activity (for example lessons completed, cards studied, days active, and AI generations used). If a store asks us for consumption information about a refund request, we may share these records so the store can decide fairly. A pattern of purchasing, fully using, and then reclaiming access may be treated as abuse.
• Chargebacks: if you think a charge is wrong, please use the Apple/Google refund process first. Opening a bank chargeback or payment dispute instead may lead to suspension of the affected account until the matter is resolved.
• Your legal rights: nothing in this section limits any refund or withdrawal rights you have under the consumer law that applies to you (for example, a statutory cooling-off period). Where such rights apply, they prevail.

5. AI-generated content

Lingmah uses AI to generate exercises, translations, and feedback, and to grade some spoken and written answers. This content is a learning aid, is provided "as is", and may be inaccurate or incomplete. Do not rely on it as professional, exam, or certification advice.

6. Acceptable use

Do not misuse the app: no attempts to break, overload, or reverse-engineer the service; no uploading unlawful, abusive, or infringing content; no using the app to harm others. We may suspend accounts that violate these Terms.

7. Intellectual property & your content

The app, its design, and its built-in content are owned by us or our licensors. Word lists and inputs you create remain yours; you grant us the limited rights needed to operate the service (store, process, and generate learning content for you). Shared cache content generated for common words may be reused to serve other learners.

8. Termination

You may stop using Lingmah and delete your account at any time. We may suspend or end access for violations of these Terms or where required by law. On account deletion, your personal data is removed as described in the Privacy Policy.

9. Disclaimers & limitation of liability

Lingmah is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, or for losses arising from reliance on AI-generated content. Nothing limits liability that cannot be limited by law.

10. Governing law

These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-laws rules.

11. Changes

We may update these Terms; material changes will be posted here with a new date. Continued use means acceptance.
